have major developments in the penn state child sex abuse case. former football coach jerry sandusky you're seeing on the screen, waiving his right to a preliminary hearing, a decision that moves him one step closer to trial on the multiple charges of child sexual assault. david lee miller has been following the story since the beginning. he is live outside the courthouse in pennsylvania with more. tell us a little bit what happened this morning? >> reporter: a lot of people could not believe what they were hearing. 8:30 this morning the hearing underway. the first thing they were told the defendant is waiving his right for the hearing thaflt was it. it was over in a matter of minutes. with me is the attorney for the accused, jerry sandusky. mr. amendola thanks for joining me. we spoke yesterday morning. you told me you were not going to waive jerry sandusky's appearance at this hearing. less than two 12 hours later everything changed. what happened? >> i had discussions with the chief prosecutor in jerry's case. as a result we both made concessions. our concession we would waive the
before a judge shocking the nation. jerry sandusky arrived at the courthouse but didn't stay long. he chose to waive a hearing during which a judge would determine if prosecutors had enough to bring it to trial. some accusers were set to testify against the former coach. now the decision moves this closer to a trial. >> we waive the opportunity to present our side. >> it has nothing to do with conceding, no plea negotiations, this is the fight of jerry sandusky's life and goes beyond the penn state-miami game of '86. >> jerry sandusky stands accused of abusing ten young boys he met through think charity -- his charity, the second mile. coach sandusky said he showered and horsed around with children but never abused him. he remains under house arrest, forced to wear an ankle monitor. david lee miller, this is very weird to a lot of lawyers, unless you cop a plea. the idea is you lock the story-tellers, the alleged victims, into a story and then poke holes in it. this is the only chance for that. >> indeed it is. it took a lot of people by surprise that this decision took place at the l
accused child molester jerry sandusky was supposed to face his accusers in court today, but that did not happen. instead, the former assistant penn state football coach waived his right to a hearing setting the stage for the next step which is a trial. this was a surprise today, david lee miller. >> reporter: there was a great deal of disbelief as well as relief and a little frustration thrown in that the preliminary hearing did not get underway as many had expected. if it had taken place, sandusky would have come face to face with many of his accusers, but minutes after the hearing got underway, the defen attorney told the court that the defendant, jerry sandusky, had agreed to waive the hearing. and that was it, it was over in about five minutes' time. the defense called the decision, and i quote, a tactical move, not cowardice or gamesmanship. they say no way are they conceding any guilt and, in fact, pled not guilty to all 52 charges. for the first time in a public setting, today jerry sandusky spoke out. >> to stay the course, to fight -- we'll have the opportunity to present ou

that he would be testifying about 1:00 today. >> reporter: one of the things jerry sandusky's attorney told me believes there may have been in his words some type of collusion or conspiracy here among the alleged victims to try to profit from charging jerry sandusky with abusing young boys. what do you say that defense theory? >> that is utterly ludicrous especially with victim number six came forth in 1998 very time this happened. told his mother. the mother told the police. he remained quiet until now until he was contacted by prosecutors. he is certainly not part of any collusion or conspiracy. >> reporter: attorney ken suggs thanks for talking with us. january 11th is the date sandusky will be arraigned but his attorney told me yesterday that they would waive that arraignment. based on what happened here today anything in this case is possible. bill: that is breaking news. david lee miller all over it. thank you for that. had the court case gone forward it would have been dramatic because the accusers were ready to confront him. today at least that won't happen. martha: those a few
at least 10 young boys decided today not to face his accusers at least not yet. jerry sandusky in court today waiving a preliminary hearing that would have required his accusers to go "on the record." now the case will instead go to trial. coach sandusky's decision came to a big surprise to court watchers. especially since he says he looked forward to facing his accusers. we're told the judge even had to silence shocked spectators in the courtroom. the defense attorney called the move a tactical decision and one he thought about. one alleged victim's lawyer says sandusky is just a coward. meantime, the former defensive coordinator at penn state is out and quarter million dollars cash bail facing more than 50 counts of child sexual abuse. he denies all the charges. saying he and the boys were just horsing around and his attorney today vowed to fight the charges, quote, to the death. >> we're ready to defend. we have always been ready to defend. today's waiver has nothing to do with conceding anything. there have been no plea negotiations. there will be no plea negotiation. >> shepard: al

and reported what jerry sandusky was doing to this young boy to two top athletic officials at penn state university who are the subject of this hearing today because they did nothing about it. david lee miller live at the courthouse in harrisburg with more. david, what do we expect today? what is going on in there? >> reporter: let me society the scene. these two administrators, martha, are accused of not doing anything about the alleged sexual abuse. furthermore they are each charged with perjury in this case. mike mcqueary is on the witness stand. he testified to the grand jury in 2010 that in 2002 he saw jerry sandusky committing a sex act with a young boy in the showers on campus at penn state university. his testimony, we have a producer in the courtroom, he told the court, i looked in a mirror, this is in the locker room and shockingly and surprisingly saw jerry with a boy in the shouldwer and appeared was directly behind the boy and the kids hands were against the wall. i turned back in the locker. jerry heard me and in hastened state i opened my locker. it appears as expected tha
